2. Duties verification service

Once a Duties Notice of Assessment is generated either via Electronic Duties Returns (EDR) or eDuties, an electronic Duties Verification (DV) is completed by the ELNO as part of the eConveyancing property settlement process. A successful duties verification is required before settlement can occur.

A DV will confirm that the Revenue NSW Duties Assessment Number (DAN) is valid and the title transfer transaction data entered in the ELNO workspace is the same as the Revenue NSW data used to assess the duty on the transaction.

The DV is triggered as soon as the DAN is entered into the ELNO workspace. As part of pre-settlement preparation, ensure the DV is conducted as early as possible to avoid delays prior to settlement.

When verification is successful, Revenue NSW will automatically populate the ELNO's Property Settlement Financial Summary with the duty payable (if any) including any interest or penalties. Any interest payable will continue to accrue daily until pre-settlement verification occurs.

On all transactions, transfer duty must be paid before the due date shown on the Duties Notice of Assessment. To avoid incurring interest, if your ELNO settlement is scheduled after the due date, you can pay the duty electronically using the payment methods displayed on the Duties Notice of Assessment. Allow up to two business days for the payment to be processed.

Duty must be paid on or before settlement for settlement to proceed, this includes transactions that settle before the statutory due date.

Repeating the Duties verification

The verification may be repeated by the practitioner at any time.

If the DAN has been entered into the workspace, the ELNO system will do an automatic verification 2 days prior to settlement, and on the day of settlement.

Unsuccessful verification

If the transaction data entered in the ELNO workspace (parties, property title and consideration) is different to the data provided to Revenue NSW, an error message will be displayed in the ELNO workspace.

The ELNO settlement process will not be able to continue until the error is resolved.

To avoid settlement delays, ensure any unsuccessful verifications are resolved as early as possible.
