Compliance Workflow Management - Privacy Collection Notice
Overview
Revenue NSW collects your personal information so that you can manage your compliance workflow online.
Revenue NSW gives priority to protecting the privacy of your personal information. We do this by handling personal information in a responsible manner and in accordance with the NSW Privacy Laws;Privacy and Personal Information Protection Act 1998 and Health Records and Information Privacy Act 2002.
Why are we collecting your personal information?
Revenue NSW is collecting your personal information for the following purposes:
- administering duties in accordance with the Duties Act 1997
- providing you with access to notifications about duties compliance
- validating your proof of identity and your personal details for access to your online account
- contacting you to request, verify, or confirm the information you provide in support of your dutiable transactions
- responding to complaints and enquiries in relation to duties, including disclosure to relevant authorities such as the NSW Ombudsman, the NSW Civil and Administrative Tribunal, etc.
- conducting audit and compliance activities to confirm that legislation has been complied with; and
- other directly related purposes.
What personal information do we collect?
Revenue NSW will collect the following information for the purposes of providing duties compliance services:
- name
- email address
- phone number
- residential and postal addresses
- date of birth
- 'foreign status' details
- marital status
- sex
- racial background
- bank details
- property details including land owned; owner details; Property ID; Land Titles Office ID; address; percentage owned; average value; residential usage; exemptions; return lodgement and payments; and residential usage
- trust information including Trust name; Trust ABN; date of birth for trustees who are an individual; and ABN/ACN/ARBN for trustees who are a company; and
- organisation information including ABN; ACN; ARBN organisation representative details; and organisation contact details.
How will we use and disclose the information?
Revenue NSW may use your personal information, and the personal information of any joint landowner or landowners, to:
- verify the information you provide Revenue NSW, or another public/private entity
- collect, maintain and use information about you for duties compliance purposes.
Revenue NSW may disclose the information to:
- public/private entities in order to verify the information you provide or request additional information as permitted by law
- NSW Police, if Revenue NSW reasonably suspects a case of fraud or other criminal activity or as permitted by law
- NSW Valuer General
- Foreign Investment Review Board (FIRB)
- Australian Taxation Office
- other third party service providers engaged by Revenue NSW to support the administration of duties;
- authorised representatives, and anyone with implied authority such as joint landowner/s for duties compliance purposes; and
- administer other taxation laws and Revenue NSW legislation such as First Home Owner Grant (New Homes) Act 2000, Unclaimed Money Act 1995, Fines Act 1996 etc.
Revenue NSW may disclose de-identified information:
- to NSW Treasury for the purposes of data analysis and aggregation to audit, analyse and report on property tax. Any report or publications on property tax will not identify any individual, and
- for research and statistical purposes in accordance with the Data Sharing (Government Sector) Act 2015.
Revenue NSW will not disclose the personal information you provide to third parties for any purposes not already stated in this privacy collection notice, or to which you have not otherwise consented, unless Revenue NSW is required, or authorised, by law to do so. We will retain your information in accordance with the law.
Are you required to provide us with this information?
Revenue NSW will only collect personal information that is necessary to deal with your duties compliance matter. Providing us with the requested information is required under the Duties Act 1997 / First Home Owner Grant and Shared Equity Act 2000/Property Tax (First Home Buyer Choice) Act 2022.
We will keep your information secure
Revenue NSW will take reasonable security measures to protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse. Your personal information will be held and disposed of securely.
