Relevant evidentiary requirements must be provided when lodgements are made for assessment of duty.

Section 163FA

Concession for acquisitions in connection with persons changing superannuation funds

  1. Copy of the transfer of shares or units
  2. A brief explanation of the background to the transfer and the entitlements to be extinguished and created. (The benefits of members of the transferor fund must be transferred to a transferee fund and the members should cease to have any rights against the transferor fund)
  3. Proof that each of the superannuation funds is a complying fund or a statutory declaration from a trustee (or a director of a corporate trustee) of each of the superannuation funds concerned stating that, in the opinion of the trustee (or director), of the fund the person will become a member of, or otherwise become entitled to benefits in respect of, will be a complying superannuation fund within 12 months after the acquisition occurs
