Relevant evidentiary requirements must be provided when lodgements are made for assessment of duty.

Sec 157H

How duty is charged on relevant acquisitions by foreign persons

  1. A formal valuation report, (including the letter of instructions) prepared by a suitably qualified person within the last 3 months of the relevant acquisition, of the unencumbered value of all the residential landholdings of the landholder and linked entities (if any)
  2. In case the land is held by more than one legal owner, the folio search for the land
  3. Evidence of payment of surcharge duty or exemption granted on the prior acquisition/s made within a statement period.

Note:

  • Surcharge duty is not applicable to a relevant acquisition in a public landholder and when a relevant acquisition in a private landholder is an exempt acquisition.
  • For evidence of payment of duty on prior acquisition/s, this could be a copy of the stamped or endorsed Acquisition Statement or Revenue NSW/OSR reference ID or DAN for each prior acquisition.
